Riding the current of these foundational questions came a renewed interest in the texts of Thomas Aquinas, especially the Summa Theologiae, I–II qq. 90–7. These eight questions in Aquinas soon gained prominence as the principal canon for Western natural law jurisprudence. From mid-century onwards, several philosophers of law from different philosophical perspectives produced monographs dealing with different aspects of natural law jurisprudence. While some were developed in more detail and general agreement with Aquinas than others, most referred to Aquinas’s account of natural law as the classical foundation for such discussions in Western philosophy.

They are of vital importance for the understanding of law and morals, and they explain why the definition of the basic forms of these in purely formal terms, without reference to any specific content of social needs, has proved so inadequate…We can say, given the setting of natural facts and aims, which make sanctions both possible and necessary in a municipal system, that this is a natural necessity; and some such phrase is needed also to convey the status of the minimum forms of protection for persons, property, and promises which are similarly indispensable features of municipal law.
